“It is not possible for anyone but Apple to sell e-books at a profit on iOS under these rules,” says Morin, founder and CEO of BeamItDown Software, which makes an e-book app called iFlow Reader and sells books via its own online store.


Apple’s new rules, announced yesterday, say that developers such as BeamItDown must make their products available through Apple’s own store, where Apple takes a 30 percent cut of revenues. The change will affect companies that make their content—everything from books to movies and videos to TV shows—available to owners of Apple devices.


Until now, Morin and others, like Amazon, have sidestepped Apple’s store by employing a clever workaround—when you click on a button to buy a book, you are taken out of the app to a browser, where the transaction takes place.


Morin says Apple has told him in the past that this was perfectly fine.


“The bottom line is that unless the FTC intervenes, this will put us out of business,” says one developer. “Given Apple’s political clout, this probably will not happen."


But now Apple has changed its tune. Its new policy says that booksellers can keep selling books outside the Apple store, but only if they also make the same books available inside Apple’s store as well.


Thing is, most customers will buy via Apple, because it’s more convenient. And that’s where the problem arises.


Morin says he makes less than 30 percent profit on the books he sells. So if he has to sell via Apple’s store, he will lose money on every book he sells. On a $10 book, he will lose $1.15.

“The bottom line is that unless the FTC intervenes, this will put us out of business,” Morin says. “Given Apple’s political clout, this probably will not happen. But there is no doubt that their practices are anti-competitive. We have a much better e-reader than Apple, but that is utterly irrelevant in the totalitarian world of iOS.”


Even the big guys, like Amazon and Barnes & Noble, will suffer under Apple’s new rules, Morin says. Amazon and Barnes & Noble did not respond immediately to requests for comment. Neither did Apple.


Worse yet, Morin says, Apple’s new policies will prevent small developers from dreaming up new ideas for the iPad. “This is the death of innovation in e-readers on iOS,” Morin says.


Apple’s new rules also have huge implications for companies like Netflix and Hulu, which sell movies and TV shows via subscription. Essentially, Apple is demanding a 30 percent cut of their ongoing revenues from iPads. That’s the price for making their content available to customers who own Apple devices.


There’s no sense fretting about whether or not this is fair. Apple has a right (and, indeed, an obligation, as far as its shareholders are concerned) to extract as much value as possible from the online ecosystem it has created.

Making Money Online With


With the national and international news game more or less dominated by traditional media and web giants like Google and Yahoo, much of the focus for companies that want to grow online is moving toward niches: sports, technology and other topics. But one of the biggest remaining unfilled niches in online content is hyper-local news. AOL has made the biggest investment in this segment, spending an estimated $50 million or so on rolling out its Patch.com network last year to almost a thousand towns. But Topix CEO Chris Tolles — whose company aggregates news and community discussions around thousands of small towns and regions — says that’s likely just the beginning of the hyper-local land rush.


The Topix co-founder says one of the reasons why local content is ripe for investment, and one of the things likely pushing AOL in that direction, is that “local monetizes better than just about anything else” in terms of advertising. “The figures show that ads are about four times as effective if you localize them,” Tolles said. This phenomenon has likely been driving advertisers to work with other avenues like Groupon, which can target individual regions or towns. Topix, meanwhile, has been making an average $4 eCPM (cost per thousand) for its advertising, says Tolles, and has also been getting much more response from large ad agencies than in the past.


Two to three years ago when a sales rep would call on some Madison Avenue firm, the 25-year-old sales guy would say “local sounds like my local news, and that sounds like my mom and dad — so no thanks.” Now they’re saying “local sounds like Foursquare and I have an iPhone and that sounds interesting, so yes.”


Local Advertising Rates are Climbing


The fact that CPMs for local advertising are up means that lots of companies like AOL and Yahoo — which is pursuing a Patch-like strategy with its Associated Content unit, which it acquired last year for an estimated $100 million — are going to be looking to amass as much content as possible so that they can get the scale necessary to make an impact on their businesses, the Topix CEO says. “It’s all about who can create a large local footprint,” he said. “I think we will see acquisitions this year, as part of a land grab from these companies, looking for someone who can deliver a large enough local footprint.”


Not surprisingly, Tolles says Topix is in a pretty good position if that happens. The local news aggregator was profitable for the first time in 2010, he says — with revenues that were up by more than 50 percent compared with the previous year. “We are one of the largest local sites in the U.S.,” the CEO says, “larger than any other except maybe one of the big newspaper chains like Gannett or McClatchy. Not bad for about 30 people in an office in Palo Alto [Calif.].” The site gets about 8 million uniques a month, he said, which is roughly the same as twice what AOL’s Patch is estimated to have across its sites.



Topix doesn’t get much attention when it comes to the online-media space, perhaps because it has been around so long. It was created in 2004 as an automated news aggregator by a team that included Rich Skrenta — who now runs Blekko — and Tolles. They used algorithms to crawl tens of thousands of news sites, blogs and other sources of information and then filtered it into topics. Over time, the company started to focus on location as the main filter, and categorized the information into more than 20,000 towns and cities. In 2005, it got a large investment from several media companies including Gannett Communications, the Tribune Co. and McClatchy.


News Is Easy — Community Is the Hard Part


And what does Tolles think about competing with Patch, as AOL pours more money into the hyper-local effort, which is now in close to a thousand different towns across the U.S.? The Topix CEO says his site doesn’t really compete with Patch in many locations yet — and when Patch has good content from a local area, “we can aggregate that too,” he says. In some ways, Topix approaches local news in the same way that The Huffington Post did with national and international news: the site pulls in and shows excerpts of stories from other news sites. But more important even than the news, says Tolles, is the fact that Topix gives readers from those areas somewhere to discuss the news.


“We started out as a news aggregator, but the thing that we have done a really good job of is giving people a place to come and talk about the content, the news from their local community” the Topix CEO says. During the mid-term elections, for example, the site created pages for every local race, all the way from sheriff to local city council. Across all of its pages, Topix gets about 4 million comments a month from readers, which is roughly the same as The Huffington Post.


“Patch may be able to set up thousands of sites in local towns, but it takes time to develop that kind of community — it doesn’t just happen overnight,” says Tolles.

Bank of America is making an 11th-hour push for inclusion in the upcoming Worst Company In America tournament. Starting in February, folks with BofA mortgages who don't have BofA bank accounts will see their current 15-day grace period for making payments cut by 40%.



From MSNBC's Red Tape blog:

Consumers who use the bank's online payment tool, Mortgage Pay, will risk a $6 fee if they fund payments using another bank's checking account and the payment falls during the final six days of the traditional 15-day grace period. Consumers who make payments from Bank of America accounts are not subject to the fee.



So... it's not really a grace period anymore for those people, is it?



Gail Hillebrand from Consumers Union (the proud parent of Consumerist) had this to say:

Let me get this straight. They tell you that you have a grace period, (then) they say, 'Oops, you only have half of it if you don't bank with us,'... That doesn't seem fair. ... This looks like a new 'gotcha,' and we have enough of those already.



Many of the people with BofA mortgages don't have an existing checking account with the bank because they didn't get their mortgage from BofA to begin with.



"You don't want to have to go around changing your checking account every time someone buys your mortgage," said Hillebrand, who says the way to avoid this problem is to make your payment before the grace period even kicks in. "This is just one more way to extract money out of you that you don't expect to have to pay."

Shortly after making the purchase, and applying the techniques explained in the video series, I started making a decent amount of money from my websites. In these video series, Michael Cheney takes us step-by-step and shows us how he made money with google's adsense, and how we can to. He explains which types of ads are better than others, which ad placements convert better, etc. This is a complete program and I would definitely recommend this to anyone. I have also bought Michael's Traffic Videos, which I also recommend.

On December 14, 2007, Maria Lauterbach disappeared in Jacksonville, NC. On January 10th of this year, local police investigators found her body and that of her unborn child buried under a fire pit in the back yard of 103 Meadow Trail in the Half Moon community, just outside the Jacksonville city limits. This week it was announced that the home, owned by Cesar Laurean and his wife, would be sold "As is, where is" at a foreclosure auction on January 5, 2009. The sale is being handled by the firm of Brock and Scott, PLLC, of nearby Wilmington, NC. A foreclosure notice set to display later in the month in the Jacksonville Daily News will detail the specifics of the house and property. From outward appearances it is a ranch style house of red brick and white siding with an attached garage.

This is just the latest twist in a case that still has far more questions than answers. Maria Lauterbach was a Lance Corporal in the Marine Corps., stationed at Camp Lejeune, NC. Maria Lauterbach began to date Cesar :Laurean in the Spring of 2007. By May, she learned that he was married to Lance Cpl. Christina Laurean, also stationed at Camp Lejeune. The Laureans have a young child together. On May 11, 2007, Maria reported to her command "two incidents of a sexual nature", and she filed a complaint with the NCIS. She was given a pregnancy test at that time and it was negative. After NCIS opened a rape investigation, Maria was reassigned to a different office and Laurean was ordered to maintain a distance from her of 1000 feet. On May 18, Laurean was interviewed by NCIS agents and denied that he had any sexual contact with her. She fell ill on June 27, and was given another pregnancy test. Her date of conception was estimated to be May 14, which was after she made the original allegations of rape, which had allegedly occurred in April. Over the summer, Maria was apparently harrassed at work by people other than Laurean. Someone keyed her car and she was slapped at one point by another Marine, according to the press conference held by Camp Lejeune officials in January of this year. The NCIS decided in October to wait until the baby was born and do a DNA test to determine if Laurean was the father before proceeding with the case. In November, Sgt. Daniel Durham let Maria Lauterbach move into his home in Midway Park because of her situation. On the day that she disappeared, there were no formal charges against Cesar Laurean at the time and he was not considered a flight risk or a danger to Maria.

Ms. Lauterbach left a note for her roommate saying that she was leaving, and disappeared December 14 from the Midway Park area, several miles from Half Moon where Laurean lived. Her car was eventually located at the bus station, where it had apparently been for several days. Questions abound about how she got from Midway Park to Laurean's home in Half Moon, and exactly how the car got back to the bus station. Did she go to his house of her own free will? To tell him that she was going UA and that the case against him would be over? It wouldn't be, of course. Once she made the allegations, his military career was over, whether he was ever convicted of any of the charges against him or not. Did they fight over that and he murdered her? And what about his wife? The District Attorney's office has repeatedly declined to charge his wife with anything. His wife presented the authorities with a note saying she was buried in the back yard and they recovered the body on January 10th. Laurean had supposedly left the note and left town the day before. The neighbors were very forthcoming with stories of how his wife came over and borrowed a shovel in the later part of December, and about the fire and how terrible it smelled and of the crowd of Marines that were present that day, also near the end of December. They also told news media of how Laurean's wife complained about having to repaint rooms of the house. To cover up the blood? After he left and before his capture, his wife was in contact with him by phone, but this is also supposedly something that is not a criminal act.

Laurean's wife is still stationed here in the Marine Corps at Camp Lejeune. She was recently granted leave by the Marine Corps. to travel to Mexico and visit her husband. The District Attorney's office in Onslow County agreed to not seek the death penalty and it was assumed that he would be returned here for trial shortly. However, he has appealed again on the basis of the fact that his only other sentencing option should he be found guilty is life without parole. He is petitioning the Mexican Government for assistance on the basis that this is cruel and unusual puinishment as well. He has allegedly killed a twenty year old woman and her unborn child. While NC law does not provide for a separate charge of murder for the death of an unborn baby, you really have to wonder what this guy's thought process is. He is charged with being responsible for the deaths of two people. What does HE think is appropriate punishment? Whether the first contact between them was rape or consensual, he was a married man pursuing a younger woman under his command. For those of you not familiar with military law, he was in violation of it on several fronts, besides the fact that he was apparently giving no consideration to the effect of his actions on his wife and child. This entire situation came from actions initiated by him.

So, on January 5, 2009, the scene of the crime will be sold to the highest bidder. The housing market here in Jacksonville is not in the dismal shape that it is in the rest of the country. This area is expecting an influx of at least eleven thousand permanent active duty Marines and their families in the next couple of years. New homes are going up on every empty patch of land and there is little problem selling existing ones. If a real estate company buys it with an eye to reselling it, they will have to inform any prosepective buyers of the house's history.

The crowds of sightseers and the hoards of national media reporters are long gone. The yard is overgrown with weeds that have turned brown with the recent frosts. Very little is reported on the case these days. We were reminded of it briefly a couple of times this year when other military women in the area, one of whom was also pregnant, were murdered. When asked about the case recently, DA Dewey Hudson replied that he is very busy these days preparing for fifty four other homicide cases that his office is prosecuting. The case that once occupied every newscast for days is quietly fading away. And now soon, someone else will occupy the house at 103 Meadow Trail.

Making Money Work


Deadline confirms the deal with Universal but isn’t able to say whether Julian Assange will participate in the film. Regardless, the movie could be a firebrand that surpasses the interest generated by Mr. Gibney’s last few films.


Julian Assange, the founder of the whistleblower organization WikiLeaks and therefore responsible for the release of thousands of confidential government documents, is a figure that people tend to either love or hate. To some he’s a hero and a champion of free speech and democracy; others see him as an enemy and someone who endangers our freedom by compromising the inner workings of government. (And there are probably many who see him as a troublesome, egocentric kid.)


All that being the case I’d say that Alex Gibney is the perfect man for this job, and I’m eagerly awaiting the results of his work.


In addition, producers at Josephson Entertainment and Michelle Krumm Prods have optioned Andrew Fowler‘s forthoming biography of Mr. Assange, called The Most Dangerous Man in the World. They plan a ‘suspenceful drama thriller’ based on the bio. The book follows the WikiLeaks founder from childhood to the present day. Producers compare the story they want to tell to All the President’s Men.


No word on a screenwriter, director or cast for the biopic at this point. Too bad Steven Soderbergh likely won’t have any interest in this; he’d be great for it. [Variety]














Social Networks



According to Cisco, criminals are targeting social network users more aggressively. In particular, criminals are spending more time and effort trying to steal users' social networking credentials, since that makes it possible to exploit the trust of all that users' friends.



Although the exploitation of trust is crucial, Cisco predicts a decline in simple phishing and social networking scams. The company expects instead a rise exploits similar to the Zeus trojan, which steals banking credentials and propagates on social networks, mobile devices and more.





Social Engineering



Cisco warns of the "seven deadly weaknesses" exploited by social engineers:




  • Sex Appeal

  • Greed

  • Vanity

  • Trust

  • Sloth

  • Compassion

  • Urgency





Even the most savvy users can fall prey to social engineering. For example, Thomas Ryan of Provide Security created fake identity called "Robin Sage." Ryan was able to get hundreds of government officials and security professionals to friend this imaginary person on social networking sites and, as a result, share personal information with Ryan.



According to the report:



Clickthrough rates for most malware or spam incidents consistently hover at around 3 percent, according to data from Cisco ScanSafe. While 3 percent may not seem high, imagine the impact of repeated waves of spam to which 3 percent of workers consistently respond to and click on. Even this small percentage is the equivalent of having a gaping hole in the network firewall that cannot be closed. Instead of trying to change human behavior, security researchers are exploring the possibility of changing the way we use software to reduce risks.


Java: The New Number One Target





Java and PDF are both frequently exploited, but according to Cisco Java exploits rose last year and PDF exploits fell. Java surpassed PDF as the most commonly exploited technology.



Cybercrime in the Post-PC Era



According to the report, Windows has been so prevalent and so easy to exploit that there was no need for criminals to try to exploit other systems. However, the proliferation of other devices and OSes along with improved security in Windows 7 has changed that.



However, this move is happening slowly. A report from Forrester on security in the post-PC era notes that mobile device OSes are inherently more secure than desktop OSes due to sandboxing. This means that even jailbroken iPhones and rooted Android phones will be harder to compromise than older Windows PCs. However, social engineers can prey on anyone, regardless of the device they are using.



The Cloud: Friend or Foe?



The report cites the cloud as having both benefits and drawbacks for security. The drawback is that data can be intercepted while traveling between a server and the devices that access it. The advantage is that having data stored off-device makes it hard to extract sensitive information from lost or stolen devices.



Money Mules



The report has an interesting section on "money mules." Once a criminal has stolen a victim's bank account information, they need a way to get the money into their own accounts without getting caught. Money mules are people who transfer money from a victim's bank account to a criminal. One way to do this is to transfer money into the mule's account, then have the mule wire it via Western Union to the criminals overseas. The recipient of the wire from Western Union might not have to provide bank account information to receive the money, making them more difficult to trace.



Some mules are low-level criminals who participate for the money. Others are duped by work at home job ads. Students and people with large debts are often targets.

However, there's a shortage of mules. "Currently, the ratio of stolen account credentials to available mule capacity could be as high as 10,000 to 1," says the report.



Winners of the Cybercrime Showcase



Cisco highlights two winners in this year's "Cybercrime Showcase" - a "good" winner and an "evil" winner.



The Good winner is Thorsten Holz of the security firm LastLine. Holz identified the top 30 servers that the botnet Pushdo/Cutwail used for sending spam. Holz got ISPs to shutdown those servers and, as a result, the rate of spam decreased from 350 billion messages per day to 300 billion per day.



The Evil winner is Stuxnet, which we've covered frequently.



What, No Malvertising?
